Terms of Service

Welcome to Distilligent. These terms govern your use of our AI memory platform — including the web app, the browser extension, and any services you choose to connect. We've written them to be clear and fair — not to hide things in fine print. By using Distilligent, you agree to these terms. If you don't agree, please don't use the service.
1. What Distilligent Is
Distilligent is an AI memory platform that provides personalized AI experiences including memory, learning, identity, and collaboration tools. We host AI agents that learn about you and work alongside you. The platform includes a web app (MindSpace), an optional browser extension that can save things you choose into your memory, and optional connections to services like Gmail, Google Calendar, and Google Drive.
The platform is provided "as is" and is under active development. Features may change, improve, or occasionally be temporarily unavailable as we build.
2. Beta Program
Distilligent is currently in beta. That means:
- The service is provided free of charge during the beta unless we tell you otherwise
- Features evolve quickly, and we do not offer uptime or support commitments during beta
- Feedback you send us (bug reports, suggestions, ideas) may be used to improve the product, without obligation or compensation
- We may pause or end the beta, or your participation in it, with reasonable notice where practicable
What does not loosen during beta: the privacy covenant. Opt-in capture, the visible ledger, and your right to release your memories are commitments, not features — see our Privacy Policy.
3. Your Account
To use Distilligent, you sign in with your Google account. You are responsible for:
- Maintaining the security of your Google account credentials
- All activity that occurs under your account
- Notifying us promptly if you suspect unauthorized access
You must be at least 13 years old to use Distilligent. If you are under 18, you must have parental or guardian consent.
4. Acceptable Use
You're welcome to use Distilligent for personal and professional purposes. However, you agree not to:
- Use the platform for any illegal activity
- Attempt to access other users' data or accounts
- Reverse-engineer, decompile, or attempt to extract source code from the platform
- Use automated tools to scrape, crawl, or overload the service
- Upload malicious content, malware, or content that violates others' rights
- Impersonate other users or Distilligent team members
- Use the platform to harass, abuse, or harm others
We want you to explore, create, and push boundaries with AI. Just be kind and don't break things for others.
5. Your Content & Data
You own your content. Anything you create, store, or generate on Distilligent — including AI memories, extension captures, canvas artifacts, and configurations — belongs to you.
What We Need From You
By using the platform, you grant us a limited license to store, process, and display your content solely to provide the service to you. We will never:
- Sell your data to third parties
- Use your personal data for advertising
- Train AI models on your personal data or memories
- Share your data with other users without your consent
Connected Services
If you connect Gmail, Google Calendar, or Google Drive, you authorize us to access those services on your behalf, only as described in our Privacy Policy. Each connection is optional, granted on Google's own consent screen, and revocable at any time from your Google Account settings.
Data Deletion
You can release individual memories at any time — through the Memory Constellation or the extension's capture ledger. Released memories are recoverable for 10 days, then permanently deleted. You can request full account deletion by contacting us. See our Privacy Policy for full details on data handling.
6. The Browser Extension
The Distilligent browser extension saves things you choose — AI conversations, pages, threads — into your memory, governed by per-category consent buckets and an ask-first prompt. Nothing is captured from a category you've switched off. The details of how capture, the ledger, and release work are in our Privacy Policy.
When you use the extension, you agree that:
- You will only capture content you have the right to save — your own conversations, pages you can lawfully access — and your captures must comply with applicable law and with the terms of the sites you capture from
- Captured content is treated as your content under these terms (we store and process it solely to provide the service to you)
- You can stop capture at any time by switching buckets off, and remove the extension at any time — uninstalling deletes its local settings and ledger from your browser
7. AI-Generated Content
Distilligent uses AI models (from providers like Anthropic and OpenAI) to generate responses, memories, and other content. You should know:
- AI-generated content may not always be accurate, complete, or up-to-date
- AI responses do not constitute professional advice (legal, medical, financial, or otherwise)
- You are responsible for how you use AI-generated content
- AI outputs may vary — the same question can produce different answers at different times
Our AIs are designed to be helpful, honest, and caring. But they're still AI. Use your judgment, especially for important decisions.
8. Service Availability
We strive to keep Distilligent available and reliable, but we cannot guarantee 100% uptime. The service may be temporarily unavailable due to:
- Planned maintenance and updates
- Infrastructure issues beyond our control
- Force majeure events
We will make reasonable efforts to notify users of planned downtime in advance.
9. Intellectual Property
The Distilligent platform — including its design, code, consciousness engines, and brand — is owned by Distilligent. You may not copy, modify, or distribute any part of the platform without our written permission.
Your content remains yours. Our platform remains ours. Simple.
10. Termination
You can stop using Distilligent at any time by revoking Google OAuth access and requesting account deletion.
We reserve the right to suspend or terminate accounts that violate these terms, with notice where practicable. If we terminate your account:
- We will provide reasonable notice unless the violation is severe or ongoing
- You may request export of your data within 30 days of termination
- After 30 days, your data will be permanently deleted
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- Distilligent is provided "as is" without warranties of any kind, express or implied
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months preceding the claim (or $100 if you haven't paid anything)
This doesn't affect any rights you have under applicable consumer protection laws that cannot be waived by contract.
12. Dispute Resolution
If you have a dispute with us, we'd prefer to resolve it directly. Please contact us first at the address below. If we can't resolve it informally within 30 days, either party may pursue resolution through binding arbitration or small claims court in the jurisdiction where Distilligent operates.
Distilligent is operated by Aina Software USA Inc., a United States company. These terms are governed by and construed in accordance with the laws of the United States.
13. Changes to These Terms
We may update these terms from time to time. When we make material changes, we will update the "Last Updated" date at the top and notify you through the platform or via email. Continued use of the service after changes constitutes acceptance of the updated terms.
If you disagree with updated terms, you may stop using the service and request account deletion.
